1. Who we are
Níco’s Trailer Rentals LLC provides short term rentals of car hauler trailers and related equipment. These Terms form a binding agreement between Níco’s Trailer Rentals LLC and the person or business that books or uses our services.
2. Eligibility and account
You must be at least 21 years old, hold a valid driver license, and have a suitable tow vehicle that meets weight and hitch requirements. You agree that the information you provide is accurate and complete.
3. Booking, pricing, and payment
Bookings may require a deposit or a card on file. You authorize us to charge your card for rental fees, taxes, delivery or pickup, tolls, tickets, damages, cleaning, late returns, and any other agreed charges.
4. Cancellations and no shows
Cancellations must be made before the start time stated in your confirmation. Late cancellations or no shows may be charged up to the full rental amount.
5. Pickup, return, and late fees
Return the trailer to the agreed location and time in the same condition, normal wear excepted. Late returns may incur an hourly or daily fee. There is a one hour grace period. If trailer is not returned on selected date at scheduled time, an additional daily rental fee will apply. If invoice is not paid within 24 hours, a late fee of $100 will apply.
6. Equipment included
Rentals may include a winch, tie down straps, a 2 5⁄16 hitch and ball, J-Hooks, and a spare tire. You are responsible for inspecting all items at pickup and returning them. Lost or damaged items may incur replacement charges.
7. Vehicle loading and securement
You are responsible for secure loading and safe operation. Follow weight limits and manufacturer instructions. Never carry passengers on the trailer. Use all tie downs and safety chains. We may provide guidance at pickup but you are responsible for the final setup and operation.
8. Tow vehicle requirements
Your tow vehicle must be rated to tow the combined weight of the trailer and load. You must use a proper receiver, hitch, ball size, safety chains, and working wiring with brake controller when required. Lights and brakes must function during the rental.
9. Use restrictions
Do not use the trailer for illegal activity, off road driving that is unsafe for the trailer, or transport of hazardous materials beyond what the law allows. Do not modify the trailer. Report any accident or damage to us immediately.
10. Out of state travel
Out of state use is allowed with prior notice. You are responsible for compliance with all laws, permits, tolls, and fees in every jurisdiction.
11. Maintenance, breakdowns, and accidents
We maintain our equipment with regular inspections. If you experience a flat tire, light issue, or other problem, contact us right away. You must stop operation if continued use is unsafe. We are not responsible for delays or costs due to weather, road conditions, or acts beyond our control.
12. Damage and cleaning
You accept responsibility for damage to the trailer or included gear that occurs during your rental, except for normal wear. Excessive dirt, fluids, or debris may incur a cleaning fee. You agree that we may charge the card on file for these amounts and provide an itemized statement.
13. Tickets, tolls, and violations
You are responsible for all tickets, tolls, penalties, and violations during the rental period. If we receive a notice we may charge your card and provide your information to the issuer when allowed.
14. Insurance
You agree to maintain auto liability insurance for your tow vehicle as required by law. We do not provide primary coverage for your vehicle or cargo. Consult your insurer about coverage for towing and transported vehicles.
15. Risk allocation
Renting and towing involve inherent risks. To the fullest extent permitted by law, our liability to you is limited to the amounts you paid for the rental in the period in which the claim arose. We are not liable for lost profits, loss of use, or indirect damages.
16. Indemnification
You agree to indemnify and hold Níco’s Trailer Rentals LLC and its employees harmless from claims or losses arising out of your use of the trailer, your loading or securement, or your violation of these Terms or the law.
17. Photos and communication
We may photograph the trailer at pickup and return for condition records. By providing your contact information you consent to receive service related messages by email, call, or text. You can opt out of marketing messages at any time.
18. Changes to bookings or Terms
We may update rates, fees, or these Terms from time to time. The version in effect when you book will govern your booking. Current Terms will be posted on our site.
19. Dispute resolution and governing law
These Terms are governed by California law. Both parties agree to resolve disputes in small claims court or through binding arbitration in Riverside County, California, with a class action waiver. Either party may seek an injunction in a court of competent jurisdiction when needed.
